Cataboligne Demon and legal rights?

Quick question for you sages of Greyhawk:
I'm interested in using the cataboligne demon in a published adventure focused on Graz'zt's realm in the Abyss. Its captivating voice, ability to disguise itself, create hallucinatory terrain, even the story of it being attacked by other demons – it all just fits so well with what I am doing with Graz'zt.
I know the cataboligne originated in Gary Gygax's novels, but it also was published in Dragon magazine in 2002, and later in WotC's Expedition to the Ruins of Greyhawk in 2007.
Does anyone happen to know where the legal rights to using the cataboligne demon lie? Are they with the Gygax Estate, have they gone to WotC, or are they shared?
Also, I know this stuff can be a sensitive subject, so apologies if this question is triggering for long-time fans of Gary's Greyhawk. Please take it in the spirit it is intended: honoring past works and writing a good adventure. Many thanks!
